Public offer agreement
General provisions
1.1. This public offer is an official offer of “Aroma Fields”, hereinafter referred to as the “Seller”, to conclude an Agreement for the sale of goods remotely, that is, through an online store, hereinafter referred to as the “Agreement”, and places a Public offer (offer ) on the official website of the Seller https://aromafields.com.ua/ (hereinafter referred to as the "Website").
1.2. The moment of full and unconditional acceptance by the Buyer of the Seller's offer (acceptance) for the conclusion of an electronic contract for the sale of goods is the fact that the Buyer pays for the order on the terms of this Agreement, on time and at the prices indicated on the Seller's website.
Concepts and definitions
2.1. This public offer, unless the context otherwise requires, contains the following terms, which have the following meaning:
* "Product" - drugs and means, accessories, components and accompanying items;
* "Online store" - in accordance with the Law of Ukraine "on electronic commerce", a means for presenting or selling a product, work or service through the implementation of an electronic agreement.
* "Seller" - a company that sells goods presented on the Internet site.
* "Buyer" - an individual who has entered into an Agreement with the Seller on the terms and conditions set forth below.
* "Order" - selection of individual items from the list of goods specified by the Buyer when placing an order and making payment.
Subject of the contract
3.1. The Seller undertakes to transfer the Goods to the Buyer's ownership, the Buyer undertakes to pay for and accept the Goods on the terms of this Agreement.
This Agreement (public offer) regulates the purchase and sale of goods in the online store, including:
- voluntary choice by the Buyer of goods in the online store;
– independent registration by the Buyer of the order in the online store;
- payment by the Buyer of the order placed in the online store;
– processing and delivery of the order to the Buyer in the property on the terms of this Agreement.
How to place an order
4.1. The buyer has the right to place an order for any product presented on the Website of the online store and available.
4.2. Each item can be presented in the order in any quantity.
4.3. In the absence of goods in stock, the Manager of the company is obliged to inform the Buyer (by phone or by e-mail).
4.4. In the absence of goods, the Buyer has the right to replace the goods of a similar model, to refuse this product, to cancel the order.
Order payment procedure
Payment on the site
5.1. Payment is made through the payment system available on the site in any way available on the payment page or by bank transfer based on the invoice received.
Payment is made in advance.
5.2. If funds are not received, the online store reserves the right to cancel the order.
Order delivery terms
6.1. Delivery of goods purchased in the online store is carried out to the warehouses of transport companies, where orders are issued.
6.2. Along with the order, the Buyer is provided with documents in accordance with the legislation of Ukraine.
Rights and obligations of the parties:
7.1. The seller has the right:
– unilaterally terminate the provision of services under this agreement in case of violation by the Buyer of the terms of this agreement.
7.2. The buyer is obliged:
- timely pay and receive orders under the terms of this contract.
7.3. The buyer has the right:
– place an order in the online store;
– draw up an electronic contract;
– require the Seller to fulfill the terms of this Agreement.
Responsibility of the parties
8.1. The parties are responsible for non-fulfillment or improper fulfillment of the terms of this agreement in the manner prescribed by this agreement and the current legislation of Ukraine.
8.2. The seller is not responsible for:
- the appearance of the Goods changed by the manufacturer;
- for a slight discrepancy in the color gamut of the product, which may differ from the photo of the product solely due to the difference in color rendering by monitors of personal computers, tablets and phones of individual models;
– for the content and truthfulness of the information provided by the Buyer when placing an order;
– for delays and interruptions in the provision of the Services (order processing and delivery of goods) that occur for reasons beyond its control;
- for unlawful illegal actions committed by the Buyer through this access to the Internet;
- for unlawful illegal actions committed by the Buyer through this access to the Internet;
8.4. In the event of the occurrence of force majeure circumstances (force majeure), the parties are exempted from fulfilling the terms of this agreement. For the purposes of this agreement, force majeure means events that are of an extraordinary, unpredictable nature, excluding or objectively interfering with the implementation of this agreement, the occurrence of which the Parties could not reasonably foresee and prevent.
8.5. The Parties shall make every effort to resolve any differences solely through negotiations.
Other conditions
9.1. The online store reserves the right to unilaterally amend this agreement, subject to its prior publication on the website https://aromafields.com.ua/
9.2. The online store was created to organize a remote method of selling goods via the Internet.
9.3. The buyer is responsible for the accuracy of the information specified when placing an order. At the same time, when making an acceptance (placement of an order and subsequent payment for the goods), the Buyer provides the Seller with his unconditional consent to the collection, processing, storage, use of his personal data, in the understanding of the Law of Ukraine "On the Protection of Personal Data".
9.4. Payment by the Buyer of the order placed in the online store means the full consent of the Buyer with the terms of the contract of sale (public offer)
9.5. The actual date of the electronic agreement between the parties is the date of acceptance of the conditions in accordance with Art. 11 of the Law of Ukraine "On Electronic Commerce"
9.6. Using the resource of the online store to preview the goods, as well as to place an order for the Buyer is free of charge.
9.7. The information provided by the Buyer is confidential. The online store uses information about the Buyer solely for the purpose of processing the order, sending messages to the Buyer, delivering goods, making mutual settlements, etc.
Procedure for returning goods of proper quality
10.1. In accordance with Article 9 of the Law of Ukraine "On Consumer Protection" and the Resolution of the Cabinet of Ministers of Ukraine dated March 19, 1994 No. 172 "On the Implementation of Certain Provisions of the Law of Ukraine "On Consumer Protection" (as amended), food additives that are part of food products, and perfumery and cosmetic products that are classified as non-food products of proper quality are not subject to exchange (return) if they do not satisfy consumers for any reason.
10.2. Exchange and return of goods of proper quality can be carried out only in the category "Accessories for aromatherapy" in accordance with the following conditions:
10.2.1. Return and exchange of goods of proper quality is carried out in accordance with Article 9 of the Law of Ukraine "On Consumer Protection" within 14 days from the date of order confirmation.
10.2.2. In case of receipt of goods of proper quality, the Buyer may return or exchange the goods by contacting manager at the contact number (068) 465 33 71 and inform about the desire to return or exchange due to non-compliance with expectations.
10.2.3. The product for return or exchange must be of proper quality, namely: no traces of use by the consumer: scratches, chips, abrasions, stains, etc.; the product packaging is preserved and not damaged; all labels and factory markings are preserved; the consumer qualities of the product are preserved; complete set; no mechanical damage; no traces of use.
10.2.4. The return is carried out by the Nova Poshta delivery service at the transport company's rates at the seller's expense.
10.2.5. The refund is made by agreement between the Buyer and Aroma Fields by transferring funds to a bank account (IBAN) after receiving and checking the shipment within 24 hours from the moment of receiving the returned goods.
Procedure for returning goods of unproper quality
11.1. The return and exchange of goods of unproper quality is carried out in accordance with Article 8 of the Law of Ukraine "On Protection of Consumer Rights".
11.2. Upon receipt of the Goods at the branch/post office or from the carrier's courier, the Buyer is obliged to check the external integrity of the packaging, then open it and directly verify the proper external condition of the goods (absence of mechanical damage) and the completeness of its completeness in the presence of the carrier's employees.
11.3. In the event of detection of defects that may indicate unproper quality of the goods, the Buyer is obliged to record them in a drawn up act of any form. The act must be signed by the Buyer and an employee of the carrier.
11.4. In case of detection of defects that may indicate unproper quality of the goods, upon receipt of the order at the post office, the buyer is obliged to record a video of unpacking the order and send it to the email address:
11.5. Within the first 24 hours after receiving the goods of unproper quality, the Buyer is obliged to notify the Aroma Fields representative by phone number (068) 465 33 71 about the identified defects and to agree on the replacement or return of the Goods.
11.6. In case of failure to comply with the mandatory requirements of the specified procedure, the Buyer is deemed to have received the Goods in good condition - without any mechanical damage and in full. Replacement or return of goods of unproper quality is carried out by the Nova Poshta delivery service at the transport company's rates at the seller's expense.
11.7. Refund of funds for goods of unproper quality is made by agreement between the Buyer and Aroma Fields by transferring funds to a bank account (IBAN) after receipt and verification of the shipment within 24 hours from the moment of receipt of the returned goods.
11.8. Appeals, claims, questions regarding service and quality of AromaFields products are considered individually and are accepted to the mailbox:
Contract term
11.1. An electronic agreement is considered concluded from the moment the person who sent the proposal to conclude such an agreement receives answers on the acceptance of this proposal in the manner prescribed by part six of Article 11 of the Law of Ukraine “On Electronic Commerce” .
11.2. Before the expiration date, this Agreement (public offer) may be terminated by mutual agreement of the parties until the actual delivery of the goods by means of a refund
11.3. The Parties have the right to terminate this Agreement unilaterally, if one of the Parties fails to comply with the terms of this Agreement and in cases provided for by the current legislation of Ukraine.
